Correct your EES record: Netherlands
If the Entry/Exit System holds wrong data about you from a crossing in Netherlands — a missing exit, a false overstay flag — Article 52 of Regulation (EU) 2017/2226 gives you the right to have it rectified. Here's who can help and what to send.
Who to contact
Autoriteit Persoonsgegevens — the Netherlands' data protection supervisory authority. Under Art. 53(2) of Regulation (EU) 2017/2226 it must, upon request, assist and advise you in exercising your EES rectification rights. The procedure
- Gather evidence of your actual movements: boarding passes, tickets, accommodation and payment records.
- Fill in one of the template letters below — state precisely which record is wrong and what the correct facts are.
- Send it via the channels above. Under Article 52 you may address your request to the competent authority of any Schengen country, not only Netherlands.
- Note the date you sent it: authorities must reply within 45 days. No answer or a refusal opens the Article 54 complaint route — the supervisory authority must assist you throughout.
- Deadline for a reply
- Reply within 45 days of receipt of an Article 52 request (Regulation (EU) 2017/2226, Art. 52(1)).
- If they refuse or don't answer
- Action or complaint before the competent authorities or courts (Art. 54); supervisory-authority assistance available throughout (Art. 54(2)).
