Overstaying in Spain: fine, entry ban and enforcement
This is what Spain's own national law adds on top of the EU-wide entry-ban mechanism — every Schengen country runs that same baseline process, explained on the general overstay-penalties page, but the fine amount and exact enforcement style are set by each country individually.
Fine
EUR 501–10,000 — Spanish authorities choose between a fine and expulsion for a given case, they aren't applied together
Entry ban
3–10 years Schengen-wide if expulsion (rather than a fine) is the outcome chosen
How it's enforced in practice
Overstay beyond 3 months is classified as a "grave" infraction under Ley Orgánica 4/2000 (LOEX) Art. 53.1(a). A proportionality principle and recent Spanish Supreme Court case law favor a fine over expulsion for a simple overstay with no aggravating factors.
