    The Prohibition of Electronic Cigarettes Act, 2019 makes it a criminal offence for any person to produce, manufacture, import, export, transport, sell, distribute, or advertise electronic cigarettes (or any part of one) in India — there is no personal-use or personal-baggage exemption in the Act's text.

    Section 7 penalty for a first offence: up to 1 year imprisonment and/or a fine up to Rs. 1,00,000 (one lakh); a second or subsequent offence carries up to 3 years imprisonment and a fine up to Rs. 5,00,000 (five lakh). This is a genuine, high-stakes traveler trap: a device that is legal and commonly carried in many other countries is a criminal offence to bring into India, not merely a confiscated item.
