Overstaying in Estonia: fine, entry ban and enforcement

This is what Estonia's own national law adds on top of the EU-wide entry-ban mechanism — every Schengen country runs that same baseline process, explained on the general overstay-penalties page, but the fine amount and exact enforcement style are set by each country individually.

Fine

Punishable as a misdemeanor (väärtegu) under Penal Code § 260; the statute's specific fine-unit amount was not confirmed against primary text this pass

Entry ban

3 years if issued at a border checkpoint for an expired Schengen-authorized stay; 5 years for a standard precept-to-leave; up to 10 years for aggravated or repeat cases

How it's enforced in practice

Governed by Estonia's Obligation to Leave and Prohibition on Entry Act. Ban-duration figures were read directly from the Act's English text via LegislationLine (an OSCE/ODIHR legal database mirroring official translations) — Estonia's own Official Gazette portal (riigiteataja.ee) is JS-rendered and didn't return text via automated fetch.

This is informational only, not legal advice — consult a qualified adviser if you're facing an actual return decision or entry ban.
